What is the process of getting an Apostille on a US birth certificate?

Any document in the US will be issued by either the State government or the Federal government.

Birth certificate apostille, Marriage certificate apostille, Death Certificate apostille, etc. come under state-issued documents. For Idaho-issued vital records, the apostille is processed by the Idaho Secretary of State.

There are 2 kinds of documents when it comes to the apostille process:

  • Documents issued by State Government – State Apostille
  • Documents issued by Federal Government – Federal Apostille

Idaho State Apostille

Idaho state government issued documents or vital documents such as a US birth certificate, US marriage certificate, or US death certificate must receive an apostille from the state of Idaho, which issued the official document.

There are 2 main ways to obtain an Idaho State Apostille on a US Birth Certificate:

  • Apostille on Certified Original US Birth Certificate
  • Apostille on Notarized Photocopy of US Birth Certificate

1. Original US Birth Certificate Apostille

The apostille is processed and issued through the Idaho Secretary of State. A certified original birth certificate (issued by the Idaho Department of Health and Welfare, Bureau of Vital Records) is required to obtain a direct state apostille. Before attaching the apostille, the Idaho Secretary of State verifies the official signature and registrar seal on the document.

Once approved, the Idaho Secretary of State attaches an official Apostille Certificate directly to your original birth certificate.

If you do not possess a certified original copy, you can request a new official birth certificate directly from the Idaho Department of Health and Welfare, Bureau of Vital Records.

2. Apostille on Notarized Copy of US Birth Certificate

You can also obtain an apostille on a notarized copy of the birth certificate where permitted. Notarization is performed by a licensed notary public in Idaho, who executes a copy certification by document custodian statement.

Based on the valid notary acknowledgment, the notarized copy is then submitted to the Idaho Secretary of State for final state apostille processing.

Note – While many Hague Convention member nations accept apostilles on notarized photocopies, certain foreign embassies or official authorities strictly require an apostille on a certified original document. Always check with the receiving authority before submitting your document for processing.

USDOS Apostille (US Department of State) or Federal Apostille

Federal documents such as FBI Background Checks, USDA Certificates, or Federal Court Orders must be apostilled at the federal level by the U.S. Department of State in Washington, D.C.

The USDOS requires official original federal documents in order to issue a Federal Apostille Certificate.

Federal documents must be couriered for physical processing to complete the federal apostille.

Steps for Embassy Attestation

  1. Notary Attestation For photocopy documents only. Original documents do not need this step.
  2. Apostille by State The state in which the document is issued will provide the state apostille on the document.
  3. Authentication by the USDOS US Department of State (federal government) also called federal attestation.
  4. Embassy Attestation After all the above attestations, the document is submitted to the embassy of the target country to obtain embassy attestation.

Important Notes

  • In case of photocopy attestation, notary public attestation is mandatory. Some countries accept photocopies for embassy attestation – check with an expert.
  • For federal documents you don’t need a State Apostille, so you can skip Step 2 for federal issued documents.

Suggestion

  • Some countries’ embassies accept direct submission after state apostille (Step 2) for state‑issued documents such as US birth certificates.
  • In this case you can skip Step 3 (USDOS Federal authentication), saving valuable time and cost.
