Any document in the US either will be issued by the State government or Federal government.

Birth certificate apostille, Marriage certificate apostille, Death Certificate apostille, etc. come under state issued documents. So the apostille will be done by the state government.

Legalization

It is a broader term. Legalization is a process of verifying any document for use in a foreign country. Is a process of authentication for Hague countries. It’s a more simpler process compared to legalization. Now let's dive into the US apostille Process.

There are 2 kinds of documents when it comes to apostille process:

  • Documents issued by State Government – State Apostille
  • Documents issued by Federal Government – Federal Apostille

Alabama State Apostille

Alabama state government issued documents or Vital documents such as US birth certificate, US Marriage Certificate, US death certificate, apostille will be done by the state of Alabama which issued the original document.

There are 2 ways in getting the Alabama State Apostille on US Birth certificate

  • Apostille on Original US birth certificate
  • Apostille on Notarized photocopy of US Birth certificate

1. Original US birth certificate Apostille

Apostille will be done by the Alabama state secretariat office. We need Original US birth certificate to get the direct apostille. Before putting the apostille on the original US birth certificate, the Alabama State government will check the details given in the documents with vitals.

Once these details are approved the document will be moved to the secretariat office. The birth certificate will receive an Apostille Certificate. An Apostille Certificate will be attached with the original document.

If you don’t have the original document you can request the Alabama state government to issue you a new Birth certificate.

2. Apostille on Notarized copy of US birth Certificate

You can also get an apostille on Notarized copy of the birth certificate. Notary will be done by the competent notary authority in Alabama. After varying the details of the original document Notary Public will do copy certification by document custodian certification.

Based on the Notary Verification the photocopy will finally be apostilled by the Alabama State Government

Note – Most of the Hague nations accept Apostille done on photocopy but some authorities will insist on getting apostille on original document only, so check with the authorities to whom you are submitting apostilled document, whether they accept the apostille done on photocopies or not.

How much time will it take to get the apostille?

Time taken to get an apostille on a US birth certificate issued in Alabama depends on the Alabama state government.   2. Apostille by State The state in which the document is issued will provide the state apostille on the document.
  3. Authentication by the USDOS US Department of State (federal government) also called federal attestation.
  4. Embassy Attestation After all the above attestations, the document is submitted to the embassy of the target country to obtain embassy attestation.

Important Notes

  • In case of photocopy attestation, notary public attestation is mandatory. Some countries accept photocopies for embassy attestation – check with an expert.
  • For federal documents you don’t need a State Apostille, so you can skip Step 2 for federal issued documents.

Suggestion

  • Some countries’ embassies accept direct submission after state apostille (Step 2) for state‑issued documents such as US birth certificates.
  • In this case you can skip Step 3 (USDOS Federal authentication), saving valuable time and cost.
